TALLAHASSEE – House Majority Leader Andy Gardiner (R-Orlando) released the
following statement today after the Senate’s passage of House Bill (HB) 145, repealing
joint and several liability by a vote of 27 to 13:
"We welcome the action taken earlier today by the Florida Senate to affirm HB 145
and the repeal of the unfair joint and several liability law. Today’s vote sends
a signal that Florida is a place where fairness is embraced and proportioned responsibility
is honored.
The long anticipated repeal of joint and several liability will be a reality once
signed by Governor Bush. By creating a level playing field where consumers’ rights
are honored and small businesses can thrive, we will strengthen an already robust
economy and increase our competitiveness among other states.
I would suggest that today’s action solidifies one of the single most important
accomplishments of the 2006 Legislative Session. We are especially grateful to Speaker
Allan Bense for bringing this discussion to the forefront. Passage of HB 145 is
a sign that effective and efficient policymaking are alive and well in the Republican-led
Legislature."
